TERMS OF SALE  

1- PRICES
The prices of our item(s) are indicated in Euros, inclusive of tax except the participation of the expenses of handling and shipment.

For all the item(s) shipped outside the European Union and Dom-Tom, the price will be automatically calculated exclusive of taxes on the invoice.

Customs duties and other local taxes, importation rights or Federal taxes are likely to be payable.  These rights and sums are not payable by Basket Connection ^TM in any case.

They will remain in charge of the Buyer and are of his/her whole responsibility as well in terms for declarations as for payments at the authorities and/or qualified organizations for the concerned country.
In this case, we advise the Buyer to inquire about these aspects at the proper local authorities.

All the orders, whatever their origin, are payable in Euros.

Basket Connection ^TM reserves the right to modify its prices at any time. The item(s) will be invoiced with the tariffs at the time of the booking of the order(s) (subject to availability).

The products remain the property of Basket Connection ^TM until the full payment of the invoice.

* ANTI FRAUD SYSTEM for Credit Cards

- In order to protect us from fraud on Internet, Basket Connection ^TM set up the following measurements:
The recording of the IP address, as well as exact date and hour of the transaction.  This single and formal identification engages the Buyer by contract. These elements will remain confidential if there is no intention of fraud.
- Any attempt at fraud, for any amount and whatever its origin, will be the subject of penal proceedings (deposit of complaint with the Public Prosecutor of Angers, France). All the collected information about the Buyer will then be transmitted to the Public Prosecutor’s office for investigation.  
- Recall of the terms of Article 313-1 of the French Penal code:

Ordinance no. 2000-916 of 19th September 2000 Article 3 Official Journal of 22nd September 2000 came into force the 1st January 2002
Fraudulent obtaining is the act of deceiving a natural or legal person by the use of a false name or a false capacity, by the abuse of a truthful capacity, or by means of unlawful manoeuvres, and thus to lead such a person, to his prejudice or to the prejudice of a third party, to transfer funds, valuables or any property, to provide a service or to consent to an act incurring or discharging an obligation.
Fraudulent obtaining is punished by five years’ imprisonment and a fine of € 375,000.

3 - VALIDATION
By validating the order, the Buyer agrees to accept fully and without reserve these Terms of Sale in its entirety. The data recorded by Basket Connection ^TM constitutes the proof of the transactions passed between Basket Connection ^TM and the Buyer.
Basket Connection ^TM will systematically confirm the order to the Buyer by email (if known) as well as the validation of the payment carried out on-line through our secured payment  system (SP PLUS of the French Bank Caisse d’Epargne  http://www.spplus.net ).

4 - AVAILABILITY
In case of unavailability of an item after placing an order, the Buyer will be informed by email or telephone.

The Buyer will then have 48 working hours (except weekends and bank holidays) to apply for the cancellation or the exchange of the order by contacting the customer service.

5 - DELIVERY, SHIPPING CHARGES
The items will be automatically sent to the Buyer’s address.
The participation of the delivery expenses is inclusive of tax. 
For the shipments outside the European Union, possible taxes (f.e.local VAT, customs duties, import tax etc.) could be invoiced at arrival of the parcel and shall be bear by the Buyer.

All the circumstances, whatever their nature, beyond the control of Basket Connection ^TM, such as case of acts of God, damage, strike, administrative decision or stop of transport, which would tend to delay, prevent and make exorbitant the execution of the supplying, constitute, a cause of suspension or extinction of the obligations of Basket Connection to its liking, without compensation for the Buyer.
In any case, any delay of delivery cannot give the right to the payment of damages, deduction or cancellation of the pending orders.

Delivery delays:

The delivery delays are average delays and correspond to the periods of handling and/or delivery.
The delays vary according to the destination and do not include bank holidays or weekends.

6 - PAYMENT TERMS
The payment of the order is carried out either by credit card on the Internet site on-line through our secured payment  system (SP PLUS of the French Bank : Caisse d’Epargne  http://www.spplus.net) or by bank check only in Euros, to be made out to Basket Connection  11 place du Pilori –  49100 – Angers (France).

The accepted credit cards by our secured payment system (SP PLUS of the French Bank : Caisse d’Epargne) are:  Aimed, Eurocard, Master Card, American Express, Aurore.

7 - SECURED PAYMENT
The internet site of Basket Connection ^TM works with one of the most efficient secured payment systems at the present time, a universal process of encoding SSL, associated with our secured payment  system (SP PLUS of the French Bank : Caisse d’Epargne  http://www.spplus.net ).

8 - INVOICE
We deliver you an invoice with every sending
An invoice is available for consultation and/or printing on the internet site through the customer service.

9 - RETURN POLICIES
Terms of Article 121-20 of the French consumption code:

(Order no. 2001-741 of 23 August 2001 art. 5 and art. 11 Journal officiel of 25 August 2001)
 
a - The consumer has seven clear days in which to exercise his/her right of withdrawal without having to give reasons or pay penalties, with the exception, where appropriate, of the cost of returning the goods.
The deadline mentioned in the previous paragraph runs from the receipt of the goods or acceptance of the offer of services.
Where the information provided for in article L. 121-19 has not been supplied, the deadline for exercising the right of withdrawal is extended to three months. Where this information is, however, supplied within three months of receipt of the goods or acceptance of the offer, this incurs the seven day deadline mentioned in the first paragraph.
Where the seven day deadline expires on a Saturday, a Sunday or a Bank holiday or a non-working day, it is extended until the next working day.

b - the Buyer can, either exchange the item(s), or ask a refund.

On the other hand, we will not be able to accept: 

- Returned items which are weared, incomplete, damaged, or soiled by the Buyer.
- parcels without the information that makes it possible to identify the shipper (order  number, name, first name, address)

The return costs will be bear by the shipper who will have to send the items to the following address: 

- Basket Connection SAV, 11 place du Pilori –  49100 – Angers (France)

The return of the item(s) will give rise to a credit, equal to the price of the purchased item(s)
The credit does not include the possible expenses of the delivery.
As soon as the handling of the return, Basket Connection ^TM will send the Buyer an email (if known) informing the Buyer of the amount of the credit.
The Buyer will then have the possibility to exchange the item(s) or to be refunded.
If the Buyer purchases an item in the 15 following days after the sending of Basket Connection ^TM’ E-mail, Basket Connection ^TM will consider that as an exchange of the returned item(s).
Basket Connection will then deduct automatically the amount from the new order.
If  the Buyer wishes to be refunded, the Buyer has to send an email or letter to Basket Connection ^TM asking for the refund.
Basket Connection ^TM will then credit the Buyer’s bank account with the exact amount.

No returns with cash on delivery (C.O.D) will be accepted, for any reason.

11 -  COPYRIGHT

All the texts, comments, works, illustrations and images on the site of Basket Connection ^TM are protected by all proprietary rights (intellectual proprietary, copyright etc.) worldwide.
Therefore, only a private use is authorised. All other use will be sanctioned (except prior authorisation of Basket Connection ^TM). All reproduction (total or partial) is strictly forbidden.

12 - LIABILITY

The items are in conformity with the French law. The liability of Basket Connection ^TM can not be committed in the event of non respect of the legislation of the country where the items are delivered. The must check near the local authorities the possibilities of importation or use of the products or services which he/she plans to order.
The photographs and texts that are illustrating the items are not contractual. Consequently, the liability of Basket Connection ^TM could not be committed in the event of error in one of these photographs or one of these texts.
Basket Connection could not be held responsible for the non-performance of the contract in case of unavailability or out-of-stock condition of the item(s), in case of acts of God, disturbance or strike in particular of post and transport services and/or communications, flood, fire.
Basket Connection ^TM will not take the responsibility for all consequential damages because of the aforementioned events and for trading loss, profit loss, exchange loss, damage or expenses.

13 -  APPLICABLE DUTY AND LITIGATIONS

These conditions are subjected to the French law. The only applicable language of these conditions is the French language.  In the case of litigation the court of Angers (France) is only qualified.

14 -  PERSONAL INFORMATION

Basket Connection ^TM commits not to reveal the information communicated by the  Buyer and the visitor of the site.  This information is confidential. The information will be used by its internal services only for the handling of the order and for the reinforcement and personalization of the communication in particular through informative letters or emails and for the personalization of the site according to the stated preferences of the users.
This article will not be able to prevent the sale nor the transfer of activities to a third.  Consequently, in accordance with the data-processing law and freedoms of January 6, 1978, the purchaser has a right of access, of correction, and opposition to the personal data relating to it.

In that case a simple request can be made by email or by mail, indicating the  E-mail address, name, first name, address.
